ABOUT MOOT COURT
A moot court (Mock Court) is an extracurricular activity in which students take part insimulated court proceedings, which usually involves drafting memorials or memoranda and participating in oral argument and to participate in the staged court proceedings that are related to a fictional dispute between parties. Mostly, moot courts are conducted in law schools where the students are expected to pursue their careers in the field of law as lawyers, arbitrators and judges; hence they’re made to practice to be trained for future along with development of the required skills. Mooting is not the same as public speaking or debating, although it shares some common elements with these activities. It is a specialised application of the art of persuasive advocacy. It has been part of the process of training lawyers for centuries and plays an important role in legal education.
Generally, moot courts are organized in the form of competitions where the areas covered are the Public International Law, Human Rights, Constitutional Law, Arbitration, International Criminal Law and Law of the Sea Convention etc. A moot court competition provides the students with a basic platform for facing the professional rivalry qualifying which requires a few steps.
Moot court does not involve actual testimony by witnesses, cross-examination, or the presentation of evidence, but is focused solely on the application of the law to a common set of evidentiary assumptions to which the competitors must be introduced. In most countries, the phrase “a moot court” may be shortened to simply “a moot”and the activity may be called “mooting”. Participants are either referred to as “mooters” or “mooties”.
PURPOSE FOR MOOT COURT
The main purpose of Mock Court is to entertain the audience. Moot Court is arranged for giving practical training and guidance to the law students about the court practice. The students have to argue as if they are arguing before real court. Moot is one of the very helpful initiatives for the students who are looking forward to becoming the lawyers. Their mooting experiences make a great difference in their CVs and resumes. All students should be encouraged by the teachers and parents to participate in the moot competitions. The schools should have mooting societies that should be responsible for organizing competitions involving the national and domestic laws as well.
